Spousal Support Is Also Called Alimony

Spousal support is an allowance for nourishment or sustenance in which one spouse may be compelled to pay the other when they are living apart or have been divorced.

It refers to an allowance of money or property which is not intended as a division of marital property. A division of property must be made prior to and without regard to any award of spousal support.

Spousal Support is a property set aside for the specific and definite purpose of supporting and maintaining the former spouse.

The obligation to support a spouse is based on the marriage contract, which requires a married person to support his or her spouse. It

Types Of Spousal Support

The Domestic Relations Court may grant two types of spousal support:

  • Spousal Support pendent lite (or temporary support) is support during the pendency of a divorce or annulment action or a legal separation proceeding.
  • Permanent support is support that is granted to a former spouse at the conclusion of such proceedings.

A party is not entitled to temporary spousal support as a matter of right. Spousal Support will not be awarded unless requested by either party to a divorce, dissolution, or legal separation.

The judge or magistrate making the determination of spousal support considers many factors in determining whether to grant it, how much will be granted, and how long it will last. It is important to hire an attorney who will help you achieve the best possible outcome.
