Dissolution of marriage under ohio law

A dissolution under Ohio law is a mutual agreement between the husband and wife, where both spouses desire to terminate their marriage. To obtain a dissolution, the parties must agree in advance on all aspects of property division, parental rights and responsibilities, child support, spousal support (formerly called alimony), and division of debts.

Residency Requirement for Dissolution of Marriage

At least one of the spouses must have been a resident of the State of Ohio for at least six months immediately prior to filing a petition for dissolution of marriage.

Separation Agreement in a Dissolution

A separation agreement must accompany a petition for dissolution. The separation agreement is simply a written agreement, typically drafted by a dissolution lawyer, setting forth how the parties propose to handle all the issues involved in the dissolution.

Both parties must agree on all issues for the court to grant the dissolution.

Dissolution in Portage County

The Portage County Domestic Relations Court will grant a dissolution within a limited time frame. The Domestic Relations Court will schedule a hearing on the petition for dissolution between 30 and 90 days after your attorney files it with the court.

Both parties, called petitioners, are required to attend the court hearing.

The court will decide whether the separation agreement is fair, just and equitable to both the husband and the wife, and will determine the various rights of the parties, including issues involving any minor children.

Parenting interests are determined by the court, which is guided by the best interests of the child, as well as other legal considerations that can be presented by your attorney.
